 More discussions around the truth of IH in their dispute with Rossi and logic

 Unfortunately things did not calm down after my pacifist  message regarding the feline nature of the E-cat

 a) Dewey Weaver wrote nicely :

 "I think that Peter Gluck may have lost the ability to reason and discern between fact and fiction."

 I consider this as highly offensive! Not for me, obviously but for the poor facts.
(Let's extend them with "factoids" to have a better insight. 
Dewey, the followings are FACTS or FICTION?

 - IH has collaborated with Andrea Rossi and for 3 long years it was silent as a grave regarding the non-value of Rossi's technology?

 - during this silent period IH made good business, got investors, tens of millions of dollars including in China - and NOT based on the technologies competitors of Rossi but on the E-Cats?

 - IH has merrily applied  for a patent based on Rossi's unsubstantiable process?

 - IH has used "stellar" for the 1MW plant to visitors (fact or fiction?)

 - the ERV, now in disgrace at IH but paid by them has reported about the results after 3, 6, 9 and 12 months but the negative feedback came only after the start of the trial by Rossi?

- the employees of IH have made all the time parallel measurements regarding the functional parameters of the plant but ha not claimed that something is not OK? (again fact of fiction?);ve

 - if IH knew that the test does not show even traces of excess heat, is useless and hopeless why they have NOT asked/told Rossi to stop? Isn't this an act of sadism toward a collaborator?

Dear Dewey- if you wish I accept having a two figures IQ xy not xyz as the smart people, but even so my IQ is offended,  as the facts are,  by your arguments
I sincerely prefer to translate a few Russian and Italian LENR papers than this dispute not generating a iota of excess of intelligence, with you. Let's see a solid condensed, convincing statement from IH- anticipating the opponent.. Official.

 b) Jed Rothwell is also polite but firm

 In his latest travesty of a blog, Peter Gluck wrote:

No, this is completely wrong in every respect, as I have pointed out many times previously:No one is pushing me.

There is nothing unnatural, implausible or unbelievable about I.H.'s claim. Any person who understands calorimetry and examines the data will agree with their analysis. If Rossi and Penon seriously believe there is 50 times output they are both certified idiots (not just Penon).
As I said, several times, I have seen some of the technical data from the calorimetry. Based on that, I am sure I.H. is correct, and Rossi is wrong. I have also seen independent verification of this data from sources outside of I.H., so I am sure it is real.

I know enough about I.H.'s "real position" regarding calorimetry to judge this matter, although I look forward to learning more. I know nothing about business arrangements or contracts.

I know enough information to judge these things with confidence. You, on the other hand, know nothing about them. All you have to go on are Rossi's assertions from his blog. These range from nonsense to impossible. The information he already released in the lawsuit rules out his claims. If the reactor were producing as much heat as he claims, he and the others in the building would be cooked. They would be dead. In fact, it is not producing any excess heat. If and when I.H. becomes free to publish the technical data, everyone will see this, and you will see that Rossi has been playing you for a fool.

 My answer

 Perhaps it is better Jed is not discontented with IH and it is excellent (see the part marked with red) that he has sufficient data re the calorimetry to have the certainty that calorimetry shows that IH is correct and Rossi is wrong. However his opinion about the ERV is not believable; idiots are jobless or self-employed in the best case.:
The ERV is a nuclear engineer and his expertise is in evaluating the energy production of nuclear plants- what's so special and mysterious with this 1MW plant? It consumes some electric energy and produces thermal energy as steam. Both easily measurable. What is so esoteric, so instable, so vulnerable here?
My bet is that Jed trying to convince us that IH owns the Truth will share with us what he knows with certainty about calorimetry and tell us why the COP was all time less than 1. Not very technically, more in principle than in details,  but those who have performed energy-heat measurements and balances will understand. 
Or what he claims is a bluff, sorry.

You know damn well that IH has not said ANYTHING yet! Except in their press release, "industrial Heat has worked for over three years to substantiate the results claimed by Mr. Rossi from the E-Cat technology – all without success." 
They are preparing a response to the lawsuit. When you see that response, you will learn what they think. Give them a chance to make their case.
Why is that so difficult for you to understand?

I regret this, I know Jed from the days when Infinite Energy magazine was created. However I think his anger has a deeper cause- he is wanting or being pushed somehow to defend IH's very unnatural, surprising and implausible position so he has to tell difficultly believable things- he also does not know much about IH's real position , arguments and justifications. Do you agree, Jed?
 As for how the "war" has started I have never seen anybody happy to make a complaint in Court, and it is not IH, but Leonardo that has made the complaint that initiated the litigation. Why not IH, if they were so angry with Rossi, given his technology's total nothingness?

This is a very complete, well written Google-trasnslatable review of the many replication experiments of the Rossi Effect- starting with Alexander Parkhomov.
here are the CONCLUSIONS:

As fuel usually it was used a mixture of nickel powder and lithium aluminum hydride
used for release of hydrogen. The mass of fuel- 1 gram, exception the first Chinese experiment (20 grams) 

In the second Chinese experiment as well as in the experiments of Khrishchanovich and of Jeff Morriss it was used a wire (conductor)  of nickel in hydrogen atmosphere
Usually the fuel is placed in a small stainless steel or nickel container with thin walls put in a hermetically closed ceramic tube made of aluminum oxide. There were also performed experiments in which in the place of ceramic there was used quartz or stainless steel.

 Electrical heating was made with wires of Fehral (Kanthal) or of Ni-chrome. These are not able to assure  a long duration functionality of the reactors. For feeding the resiatance it was used alternative, continuous or impulse current.

 In alll experiments except those of China, of Khrishchanovich and of Jeff Moriis there was not used vacuum before the test. The pressure in the reactor usually does not rises above few bars at temperatures of 180-200 C and at continuing heating it remains at this level or decreases. In the majority of experiments there are used controllers for maintaining the desired temperatures. Heating up to the working temperature is made in a few hours.

  Four experiments for the evaluation of the heat release had specil calorimeters. In the others it was used a combination of reactors with and without fuel for comparison.
The released heat was greater then the used energy in the limits of COP from 1.2 to 2.7.

 Thje work of reactors was interrupted either due to destruction of the reactors or due to the end of working day were shifts were not feasible.

a) Andrea Rossi about IH's calorimetry discontent
IH is not contented with the calorimetry ???
The calorimetry has been made by a nuclear engineer who got the doctorate when he was 24 years old with 110/110 summa cum laude, at the State University of Bologna, then worked in a nuclear plant, then worked as certificator- validator of plants , collaborating with Bureau Veritas, CGS etc. He has been chosen in agreement between IH and Leonardo. Has been paid fifty-fifty by IH and Leonardo.
The calorimetry has been made along the protocol that has been agreed upon by contract with IH.

The same calorimetry has been used from February 2015 : IH received every 3 months the reports of the calorimetry by means of which Darden disseminated interviews and collected 150 millions. Never complained the calorimetry after the first 3 trimestral reports. They discovered that the calorimety was not good only with the 4th report, when it was time to pay....

 For me this sound normal, logical, plausible. However Jed Rothwell insist to defend a position that is apparently missing these qualities- and I really do not envy him. He is considered an authority in LENR based on his work and merits that even his personal enemies must recognize. In the same time he is very, too direct- see what he says -with taking responsibility- about the ERV - and this is equally an insult to IH. (see what AXIL says below in "his" column. I see here based on my 51

 b) Jed Rothwell's answer- yesterday more precise

You left out the context of my statement. You asked me: "Jed, when have you heard the first time from IH that the plant does not work- in which form was this expressed?"
My response: "I don't recall when. Many months ago. It was expressed in plain English. With unrefined Anglo-Saxon words . ."
You asked "how was it expressed?" My answer, "plain English" or "Anglo-Saxon" is an old fashioned way of saying "they were upset" or "they used rough language" or "they said it very clearly."

"But I have an answer too. You say that zero excess heat, ERV has also zero professional value, you heard the plant does not work many month ago but you cannot say exactly when and how just it was in plain Anglo-Saxon English- these are
distorted facts."
No, those facts are not distorted. I heard a long time ago; I do not recall when; and I am not free to tell you exactly why or what was said. The ERV, Penon, is an idiot, and he not qualified to evaluate calorimetry, as you see from his previously published evaluations.

"The text is there and anybody can decide if it is so."

Of course it is so. Do you think I am lying? Why would I? I have no motivation to lie about this. To use another old fashioned American idiom, I have no dog in this fight. (Meaning I have no personal stake in the matter.)

"I will not insist the idea of zero excess heat seems to be surrealistic to me."

Surrealistic or not, there is no excess heat. Facts are facts.

 This interview, published surely after the ERV's 2nd Report was an other lots opportunity to complain about the non-functional 1MW Rossi technology plant:

c) My reaction and comments to that

First of all I am pleased that this Anglo-Saxon words are better for direct speech ahs to be taken a bit metaphorically to as"they were upset" Very ffine linguistically for me it is much easier to detect Latinized words and select the Anglo-Saxons by difference,
However this fact-they were upset- and have complained about it is a nasty problem indeed. See please the Motto. Complaining...something you are forced to do many times in life a, but and profession but you know it is f low efficacy and efficiency and the results critically depend on TO WHOM YOU COMPLAIN? An imaginary proverb says never lament to your mother-in-law about your toxic boss; she cannot help. What on the Earth could be the reason of IH to complain yto a leading member of the LENR community? Can he stimulate his colleagues already getting funds from IH to outrossi Rossi? Or to help with COP=1 plant to make it to have COP>6?

Just for my dear readers I want to remind here that I had to complain many times in my career against people sabotaging my research plans- see an extreme case here (please search for "Lomechusa) in this.
Lomechusas are kind of trolls in the nest of ants.
Complain did not help and I have divorced from a bad workplace- IH could do the same, really!

To whom else has IH sent these early complains and why to them? No idea!
It is fine to know from Jed that indeed there si no excess heat according to LENR
but it is very strange and offending to hear they have hired a totally incompetent person (according to Jed) as ERV.

IH accepted Penon as a expert in the vision and construction of the test. They commented to Penon judgment in absolute terms without any direction or structure, pre-approval, or direction or feedback during his tenure of employment.

IH has demonstrated criminal incompetence to the interests of their shareholders. 

 Also
How can IH now claim any expertise or competence of the operability of the reactor if during the test of the reactor they gave Penon absolute discretion in the evaluation of the reactor? 

How could this knowledge spring to life so quickly? 

 The legal case will not cover the merits or substance of the test, it will discover who gave absolute authority to the tester, how the tester was initially instructed, what feedback the tester received during the test, and the technical and managerial incompetence of the employer of the tester. 

 When it comes to evaluating incompetence, the buck stops at the top. It was the responsiblity to setup a test to satisfy them if the reactor performes based on a specification.

IH passed that responsibility to the ERV and he became the duly authorised representative to administer the test of the Rossi reactor for IH.

The court will determine if the ERV findings are fully authorized by IH and binding on IH irrespective of what those finding resolved to be.

If IH contracted an idiot, where does the buck stop for the activities of that idiot? Clearly, IH is totally responsible and bound by what the ERV has done.

Jed Rothwell's answer to my editorial of yesterday.

 You wrote: "One of our colleagues here who seems to have excellent connection with IH now reveals now says that he knew from them - from months ago- that the !MW plant has never, ever produced a single Watt of excess heat!"

Again you have distorted the facts. I did not say anything like that. I said that during the test, experts from I.H. and elsewhere told me they were not happy with the calorimetry. I said -- repeatedly, very clearly -- that I was hoping the problems would be fixed and that I.H. and Rossi would agree on the results. I was hoping for a positive final report. That is why I agreed to take part in Mats Lewan's symposium, which was predicated on a positive report.Unfortunately, as you see in the I.H. March 10 press release, they did not reach agreement:

Then, in the I.H. response to the lawsuit, I.H. said:

"Industrial Heat has worked for over three years to substantiate the results claimed by Mr. Rossi from the E-Cat technology – all without success."

They told that means the 1 MW reactor does not produce excess heat. They disagree with Rossi's conclusions. They think his calorimetry is invalid. I was not aware of this conclusion until this press release was published. I had only heard there were disagreements.

I know a great deal about both Rossi's work and I.H.'s work. Based on what I know, in my opinion it likely that I.H. is correct and Rossi is wrong. That is all there is to it.

This is a technical dispute. It has nothing to do with politics or money. If the reactor worked as claimed, I am sure I.H. would be happy to pay for it. As things now stand, if they do not pay, they will not get any intellectual property. Why would they throw away an $11 million investment if they thought the reactor works? That makes no sense.

You need to wait and read I.H.'s response to the lawsuit before you take sides. Your speculation about politics and I.H.'s motivations are unfounded nonsense. You know nothing about the technical details of the calorimetry or why I.H. does not agree with Rossi's analysis. Until you have a chance to review the technical data, you cannot know what is going on here and you have no reason to think Rossi is right and I.H. is wrong.

 I thank you for the fast answer.  The most important thing I have learnt from it was - a great linguistic truth you have revealed to me. You said about IH's answer:

Thst means if you want to speak more directly, call the things on their real names straightly, use nude facts and not their cosmeticized forms-it is better to use words of Anglo-Saxon origin. However now the essence of your messages is this: "IH was not happy with the calorimetry" In plain English, at the level of kWatts we have to speak about heat and energy measurement - heat is Anglo Saxon whilecalorimetry not. Obviously their degree of discontent has increased hugely after the start of the trial- however you are right, this is technical problem that will be solved but the difference between COp50 and COP 1 is indeed hyperbolic- one part is right the other not.

 I like such discussions but I do not fear from the more violent ones- I told about my degrees in verbal karate.However these more normal and decent discussions are connected to an other sport of fighting.
A popular expression in Romanian says: " a fi uns cu toate alifiile"-  literally to be smeared with all the ointments in English it is "to be up to all the dodges, fiddles, tricks"- which one is genuinely Anglo-Saxon? It also applies to an individual with a very broad life experience.
In a way the expression is derived from the practise of the ancient Greek wrestling, the fighters bodies were as oily and as unctous as possible- two factors were decisive for a victory: force and lubriciousness.
